Mewujudkan Keadilan: Perlindungan Hukum bagi Perempuan Korban KDRT dalam Sistem Peradilan Pidana Indonesia
Realizing Justice: Legal Protection for Women Victims of Domestic Violence in the Indonesian Criminal Justice System
Abstract
Kasus kekerasan terhadap perempuan di Indonesia masih menjadi persoalan yang memprihatinkan. Korban seringkali sulit mendapatkan keadilan karena berbagai hambatan, mulai dari stigma sosial, ketergantungan ekonomi pada pelaku, hingga kelemahan dalam sistem hukum. Meski sudah ada berbagai instrumen hukum untuk melindungi hak-hak perempuan, implementasinya masih jauh dari harapan. Penelitian ini bertujuan untuk menganalisis peradilan hukum terkait kasus kekerasan dalam rumah tangga (KDRT) yang dialami perempuan di Indonesia. Dengan metode penelitian normatif dan pendekatan perundang-undangan serta konseptual, kajian ini menelaah ketentuan hukum yang ada, peran aparat penegak hukum, serta faktor-faktor sosial budaya yang mempengaruhi akses keadilan bagi perempuan korban kekerasan. Hasil penelitian menunjukkan bahwa meskipun sudah ada kemajuan dalam perlindungan hukum bagi perempuan, namun masih banyak celah dan kelemahan dalam formulasi hukum maupun praktik peradilan yang tidak sensitif gender. Selain penguatan aspek normatif, perlu ada perubahan paradigma dalam sistem peradilan pidana agar lebih responsif pada kebutuhan korban dan bebas dari bias gender. Peningkatan kesadaran masyarakat untuk mendukung korban dan menolak segala bentuk kekerasan juga menjadi kunci dalam mewujudkan keadilan substansial bagi perempuan.
